Robert Birach
Immigration Law:
He counsels and represents individuals and families facing issues with the U.S. immigration process including visa petitions, adjustment of status, overseas processing, naturalization, petitions to remove conditions from status, employment authorization, visa extensions, assistance in responding to Notices of Intent to Deny or Revoke, administrative appeals, and political asylum.

He counsels and represents employers and employees with employment based immigration issues such as non-immigrant visas for temporary workers (H-1B), seasonal workers (H-2B), intra-company transferees (L-1A), treaty trade and investor visas (E-1 and E-2), labor certification (PERM), immigrant visa petitions, adjustment of status, and third country visa processing for movement of employees in and out of the United States and between third countries.

Immigration Litigation:
He provides representation before the Executive Office for Immigration Review, fighting to keep families together and prevent loss of legal status in deportation and removal proceedings and bond proceedings.

He represents clients in both Federal District and Federal Circuit Courts of Appeals seeking Writs of Mandamus to compel government action, Writs of Habeas Corpus to secure the release of wrongfully detained persons, naturalization review, appeals of EOIR decisions to the Board of Immigration Appeals and appeals of BIA decisions to the Circuit Courts of Appeal.

Regulatory Compliance:
He counsels and represents Fortune 500 companies and medium/small businesses regarding compliance with and enforcement of U.S. immigration laws, performs I-9 audits, reviews public files required to be maintained by the Department of Labor and Department of Homeland Security, counsels clients and prepares them for impending interviews/investigations by DHS, negotiates on their behalf to lessen or eliminate fines and penalties and, if necessary, represents them in litigation arising from immigration violations.  In addition he provides counseling and advice to correct flaws discovered during the audit process without violating anti-discrimination laws and regulations of the Department of Labor.
